Sweepstakes Rules
No purchase necessary to enter or win. Winner need not be present to win.
How to Enter:
Eligible entrants may enter the Drive Clean Across Texas Sweepstakes (the "Sweepstakes") online starting at 12 p.m. noon (CST) on April 16, 2008, and ending at 11:59 p.m. (CST) on August 17, 2008 (the "Promotion Period"). To enter the Sweepstakes online, visit www.drivecleanacrosstexas.org, the Drive Clean Across Texas contest Flash page at dallascowboys.com, dallasdesperados.com, or pigskintexas.com and follow the links to complete all required information accurately on the registration form. You must provide a valid e-mail address, telephone number, date of birth, and contact information for use throughout the Sweepstakes. Your answers to any voluntary survey questions on the registration will not have an effect on your ability to participate or win. Limit one (1) entry per person. Participant may not enter with multiple e-mail addresses nor may participant use any other device or artifice to obtain more than the stated number of Sweepstakes entries. Any participant who attempts to participate with multiple e-mail addresses or under multiple identities or uses any device or artifice to obtain more than the stated number of entries will be disqualified. No other form of e-mail or Internet participation is valid. Eligible entrants also may enter by filling out official Sweepstakes Entry Forms at certain Blue Star Media ("Sponsor") or Drive Clean Across Texas Campaign events. Entries may not be mailed.
Random Drawing:
The winner will be selected in a random drawing held on or about August 18, 2008, from all eligible entries received. The winner will be notified by e-mail or phone call within ten (10) business days following the drawing date.
Prizes/Odds:
Grand Prize (1): Blue Star Media ("Sponsor") will give the winner a 2008 Ford Escape Hybrid (Approximate Retail Value: $30,480, not including state sales tax and vehicle license and registration fees). The Grand Prize is non-transferable and non-redeemable for cash. No substitution of prize vehicle is permitted. Blue Star Media reserves the right in its sole discretion to substitute prize vehicle with a prize of comparable value. The prize vehicle will be delivered to winner at an authorized dealership, or other location designated by Blue Star Media. All travel and transportation costs associated with collecting the prize vehicle will be the sole responsibility of the winner. Blue Star Media is not responsible for any delays in delivery of the prize vehicle. The winner shall bear all risk of loss or damage to the prize vehicle after it has been delivered to the specified delivery site, and if the prize vehicle is not picked up within thirty (30) days of the date the prize vehicle is delivered to the specified delivery site, the prize vehicle shall be automatically forfeited by the winner and an alternate winner will be selected. All federal, state, and local income taxes, sales tax, registration, and insurance fees associated with the prize vehicle, as well as all other costs involved in claiming, operating, or owning the vehicle are the sole responsibility of the winner. Blue Star Media will issue winner an IRS form 1099 for the prize based on the Actual Retail Value (ARV) of the prize vehicle. The winner of the prize vehicle is not eligible for any manufacturer's cash rebate programs. Winner must personally retrieve the prize vehicle and provide adequate personal identification and proof of a valid driver's license and satisfactory proof of insurance to take delivery of the prize vehicle. Prize winner is solely responsible for all insurance with respect to the prize vehicle. SPONSOR is not responsible for lost or stolen prize vehicle once it is awarded. Odds of winning depend on the number of eligible entries received. Taxes on the prize are solely the responsibility of the winner. Prize will be donated directly to the selected winner by Blue Star Media.
Eligibility:
This Sweepstakes is open to legal residents of Texas who have a current Texas address, who are age 18 years or older and who hold a valid Texas drivers license as of April 16, 2008. Commissioners and employees and immediate family or household members of the Texas Department of Transportation, Texas Transportation Institute, the Texas Commission on Environmental Quality, Sherry Matthews Advocacy Marketing, Blue Star Media, the Dallas Desperados, the Dallas Cowboys, supporting state and federal agencies (Texas Department of Public Safety, Texas Department of State Health Services, U.S. Environmental Protection Agency) of the Drive Clean Across Texas campaign, and Texas air quality partner programs are ineligible to participate in this Sweepstakes. Sponsor reserves the right to verify eligibility qualifications of any winner. This Sweepstakes is subject to and governed by all federal, state and local laws and regulations of the United States.
Conditions of Entry:
By entering, entrants acknowledge and agree that they have read, complied with, and will be bound by these Official Rules. Neither Sponsor, affiliates, subsidiaries, divisions, advertising and promotion agencies, prize donors, nor any telephone network or service providers are responsible for incorrect or inaccurate transcription of entry information or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect or line failures of any telephone network, computer equipment, software, inability to access any website, online service or the entry form, nor any other error or malfunction, nor late, lost, misdirected, incomplete, illegible, or damaged entries.
Winner Selection and Notification:
Entries are the property of Sponsor and will not be returned. The winners will be notified by e-mail or phone call within ten (10) business days from date of the drawing, but Sponsor reserves the right to determine the method of notification. Winner will be given ten (10) days from the date notification is received to respond. A non-response by the winner or non-receipt of notification response after the specified ten (10) days will be considered winner's forfeiture of prize and an alternate winner may be selected from the pool of remaining eligible entries. The prize claimed will be awarded. In the event of non-compliance by the winner with these Official Rules, an alternate winner may be awarded the respective prize. The prize is non-transferable. Sponsor shall not be liable for 1) failed, returned or misdirected prize notifications based on inaccurate information provided by the winner, nor 2) entries and/or responses to winner notifications which are lost, late, incorrectly completed, incomplete, illegible, unintelligible, misdirected, damaged, or otherwise not received by the intended recipient in whole or in part, nor for computer or technical error of any kind. Return of any prize or prize notification as undeliverable will result in disqualification and an alternate winner may be selected. If an entrant is found to be ineligible, an alternate winner may be selected from the pool of remaining eligible entries.
Upon request of the Sponsor, winners must sign and return an Affidavit of Eligibility and Liability/Publicity Release within fourteen (14) days of prize notification, or an alternate winner may be selected from the pool of eligible entries.
In the event of a dispute, entries will be deemed to have been made by the holder of the e-mail account associated with the entry.
Consent and Releases:
By participating, entrants agree that the Sponsor, those involved in the development, production (including prize donors), implementation and distribution of this promotion and their affiliates, subsidiaries, service providers, agencies and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or the promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Sweepstakes, including entry and participation in this Sweepstakes and acceptance, possession, use or misuse of the prize. All entrants further agree that in the event of any third party claims, damages, losses or injuries or death arising from or relating to this Sweepstakes or winner's use of the prize, they will indemnify Sponsor from any and all such claims, including the attorneys' fees related thereto.
Grand Prize winner agrees that neither Sponsor nor Ford Motor Company has made or is responsible in any manner for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prize vehicle, including but not limited to its quality, mechanical condition, merchantability or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply.
Sponsor shall not be responsible for entries that are corrupted or otherwise not received correctly or for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of e-mail, or on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participant’s or any other person’s computer related to or resulting from participating or downloading materials in the Sweepstakes. Sponsor shall not be responsible for any lost, late or misdirected entries. Any person attempting to defraud or in any way tamper with this Sweepstakes will be ineligible for the prize and may be prosecuted to the full extent of the law.
Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend this Sweepstakes in the event that the Sweepstakes is not capable of running as planned should computer viruses, bugs, tampering, fraud or other cause(s) beyond Sponsor's control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes. Sponsor reserves the right to modify the Official Rules for any reason. Sponsor also reserves the right to extend the Promotion Period for any reason. In the event that the Promotion Period is extended, Sponsor will provide a notice to that effect giving the new closing date and time on the website www.drivecleanacrosstexas.org. This Sweepstakes shall be governed by Texas law, and entrants agree that Texas courts shall have exclusive jurisdiction over any dispute or litigation arising from or relating to this Sweepstakes.
Except where prohibited by law, acceptance of any prize constitutes permission for Sponsor to use the winner's name, photograph, likeness, voice, address (city and state), and testimonials in printed, broadcast or new media, in perpetuity, in any manner they deem appropriate in connection with promoting this or any other Sweepstakes and/or promotion, without further compensation.
Rules/Winner’s Name:
The name of the winner may be posted at the Drive Clean Across Texas website, after winners are notified. To receive a copy of the Official Rules, or the name of the winner, send a self-addressed stamped envelope to Blue Star Media, Attention Thomas J. Finn, One Cowboys Parkway, Irving, Texas, 75063. Specify winners' list and/or rules on your request.

Drive Clean Across Texas is a public education initiative sponsored by the Texas Department of Transportation and the Texas Commission on Environmental Quality to encourage Texas drivers to take voluntary steps to reduce air pollution. Neither the Texas Department of Transportation nor the Texas Commission on Environmental Quality has any role in securing or providing the Sweepstakes prize to the winner. Provision of the Sweepstakes prize is the sole responsibility of Blue Star Media.
