FUNDS FOR FITNESS AWARD PROGRAM
Dallas Cowboys want YOU to nominate your favorite Health and Wellness Educator. We want to hear from YOU, tell us about your favorite Texas public school teacher, coach, or administrator that impacts health and wellness ("Wellness Educators").
The program will run from September 1 2023 - March 1, 2024 with up to twelve (12) Wellness Educators recognized during that time. This is a new twist on an existing program encouraging nominations for health and wellness educators.
Winners will be notified via email and recognition ceremonies scheduled by the Dallas Cowboys at the team's, winner's and school's convenience. Winning Wellness Educators will receive a onetime five- thousand dollar ($5,000) award payable to their school to be used exclusively for health and wellness programming.

ELIGIBILITY: The Dallas Cowboys and Texas Lottery Funds For Fitness (the "Award Program") is open to full-time public school employees such as teachers, counselors and administrators in the fields of health and wellness across the state of Texas (excluding the 75-mile radius around Houston) ("Eligible Schools") who are in need of funds to support physical fitness and well-being initiatives among elementary, middle, and high school students ("Program"). All eligible entries must meet the above criteria and all requirements set forth in the nominations for consideration (the "Qualifying Nominations"). Employees of the Administrator, the Released Parties (as defined below), and their respective subsidiaries and affiliates, and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Award Program is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes entrant's full and unconditional agreement to these official rules and Administrator's decisions, which are final and binding in all matters related to the Award Program.
ADMINISTRATOR: is defined as Pro Silver Star, Ltd., One Cowboys Way, Suite 100, Frisco, Texas 75034.
SPONSOR: is defined as Texas Lottery Commission, 1801 N. Congress Ave., Austin, Texas 78701.
REQUIREMENTS: Awards must be used within six (6) months from the date the Award is awarded and must be used for the Program originally nominated. If Winners are unable to complete the Program in six (6) months or the Program nominated is no longer achievable, Winner must submit a request for extension of time and/or request to use the Award for a different purpose. Administrator, in its sole discretion, will then approve or deny the Winner's request in writing. Furthermore, Winners must submit pictures, videos and/or written statements to the Administrator demonstrating how the Award was used.
NOMINATION PERIOD: The Award Program application is available September 1 2023 - March 1, 2024 at 11:59 p.m. CST (the "Nomination Period").
HOW TO ENTER: During the Nomination Period, visit www.dallascowboys.com/fundsforfitness and follow the links and instructions to complete and submit the Award Program nomination. Each nominator must explain how the nominee's work impacts youth health and wellness and how the award fund could further impact their programs. Submissions may include short videos or still photographs. Nominators with Qualifying Nominations will receive a notification via email that the nomination has been submitted. Eligible Schools may have multiple nominees during the Nomination Period. All entries submitted become the sole property of Administrator. Administrator has no obligation to return anything submitted by nominator as part of the application process.
JUDGING TO DETERMINE WINNERS: Throughout the Nomination Period, all Qualifying Nominations will be judged by professionals employed by the Dallas Cowboys Football Club, Ltd. (such individuals are referred to as the "Contest Judges") to determine twelve (12) winners ("Winners") during the application period (September 1 2023 - March 1, 2024). The selection of the potential Award (as defined below) recipients are final and binding in all matters related to the Award Program. All nominees with Qualifying Nominations will be considered for the Award.
WINNERS NOTIFICATION: Non-winning nominations will not carry over into subsequent award programs for consideration. The Winner will be notified by email, or phone, and will have 24 hours to claim their respective Award. An authorized representative of the school with signing authority will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release ("Release") on behalf of the winning school and Winner, which must be received by Administrator, within two (2) days of the date notice or attempted notice is sent, in order to claim the Award. If the Winner of any award cannot be contacted, fails to sign and return the Declaration or provide any other requested information, within the required time period (if applicable), or the Award is returned as undeliverable, the Winner forfeits the Award. In the event that a Winner is disqualified for any reason, Administrator will award the applicable Award to an alternate winner by judging from among all remaining Qualifying Nominations. Additional alternate judging will be held until the award is given.
AWARDS: There will be approximately twelve (12) Award Program Winners, each winner will receive a five-thousand dollar ($5,000.00) award. There will be approximately two (2) Award Program Winners per month over the course of the Nomination Period starting September 2023 based on the Qualifying Nominations submitted. Awards are non-transferable and no substitution will be made except as provided herein at the Administrator's sole discretion. Winners are responsible for all taxes and fees associated with the Award receipt and/or use. Odds of winning an Award depend on the number of eligible entries received during the applicable Nomination Period. Limit: One Award per Winner.
RELEASE: By submitting a nomination to this Award Program and/or receiving an Award, nominators and Winner(s) agree to release and hold harmless Administrator, Dallas Cowboys Football Club, Ltd. ("Dallas Cowboys"), any Dallas Cowboys player, Gene and Jerry Jones Family Foundation, the National Football League and its member clubs, Facebook, Twitter, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from mechanical errors and other errors, inaccurate, fraudulent, incomplete, late, lost, misdirected entries; or any delays in delivery of prize; or bodily injuries, death, losses or damages of any kind, without limitation, that may arise from or in connection with nominator's participation in this Award Program or Winner's acceptance, possession or use of the Award, or participation in award-related activities.
PUBLICITY: Except where prohibited, participation in the Award Program constitutes each nominator's and/or Winner's consent to Administrator and its agents' use of entrant's name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. In the case of Dallas Independent School District ("DISD"), in the event that Administrator wishes to use nominator's and/or Winner's name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration, Administrator will contact entrant to obtain express prior written approval of the content from DISD. Approval or disapproval must be granted within forty-eight (48) hours of notification.
GENERAL CONDITIONS: This Award Program is in no way sponsored, endorsed or administered by, or associated with Facebook or Twitter. Any questions, comments or concerns regarding the Award Program must be directed to the Administrator, and not to Facebook or Twitter. Administrator reserves the right to cancel, suspend and/or modify the Award Program, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Award Program, as determined by Administrator in its sole discretion. Administrator reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the nomination process or the operation of the Award Program or to be acting in violation of the official rules of this or any other Award Program or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Award Program may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator's failure to enforce any term of these official rules shall not constitute a waiver of that provision.
LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by nominators, printing errors or by any of the equipment or programming associated with or utilized in the Award Program; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Award Program; (4) technical or human error which may occur in the administration of the Award Program or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from nominator's and/or Winners participation in the Award Program or receipt or use or misuse of any Award. No more than the stated number of awards will be awarded.
APPLICABLE LAW: This Award Program and these official rules shall be construed and governed in accordance with the laws of the State of Texas. As a condition to participating in this Award Program, each nominator and/or Winner agree that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this Award Program will be resolved individually, without resort to any form of class action, exclusively before a court located in the State of Texas. The nominator and/or Winner and Administrator hereby waive any and all right to trial by jury. If any provision of these official rules are declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law. All federal, state and local laws and regulations apply.
ENTRANT'S PERSONAL INFORMATION: Information collected from nominators and/or Winners is subject to Administrator's Privacy Policy www.dallascowboys.com/privacy. By participating in the Award Program, nominators and/or Winners hereby agree to all of the terms and conditions of the privacy statement of the Administrator.
