Dallas Cowboys | Funds For Fitness - Official Rules

ELIGIBILITY: Dallas Cowboys Funds For Fitness (the "Grant Program") is open to public school teachers and administrators across the state of Texas (excluding the 75-mile radius around Houston) ("Eligible Schools") who are in need of funds to support physical fitness and wellbeing initiatives among elementary, middle, and high school students ("Program"). All eligible entries must meet the above criteria and all requirements set forth in the application for consideration (the "Qualifying Applications"). Employees of the Administrator, the Released Parties (as defined below), and their respective subsidiaries and affiliates, and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Grant Program is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes entrant's full and unconditional agreement to these official rules and Administrator's decisions, which are final and binding in all matters related to the Grant Program.

REQUIREMENTS: Grants must be used within six (6) months from the date the Grant is awarded and must be used for the Program originally submitted. If Winners are unable to complete the Program in six (6) months or the Program submitted is no longer achievable, Winner must submit a request for extension of time and/or request to use the Grant for a different purpose. Administrator will then approve or deny the Winner's request in writing. Furthermore, Winners must submit pictures, videos and/or written statement to the 'poster board' located on the submission website demonstrating how the Grant was used.

APPLICATION PERIOD: The Grant Program application is available between February 1, 2020 at 12:00 a.m. Central Standard Time ("CST") and August 14th 2020 at 11:59 p.m. CST (the "Application Period").

HOW TO ENTER: During the Application Period, visit https://www.dallascowboys.com/fundsforfitness and follow the links and instructions to complete and submit the Grant Program application. Each entrant must explain the objective of their Program, what the funds will be used for, and the timeline for their Program to be executed. Submissions may include short videos or still photographs. Entrants with Qualifying Applications will receive a notification via email that the application has been submitted. Eligible Schools may have multiple entrants, provided however, each entrant must apply for a different Program during the Application Period. All entries submitted become the sole property of Administrator. Administrator has no obligation to return anything submitted by entrant as part of the application process.

JUDGING TO DETERMINE FINALIST AND WINNERS: At the conclusion of the Application Period, all Qualifying Applications will be judged by professionals employed by the Dallas Cowboys (such individuals are referred to as the "Contest Judges"). The Contest Judges will pick finalists ("Finalists") and provide those Finalist to a panel of celebrity judges consisting of professionals employed or associated with the Dallas Cowboys (such individuals are referred to as the "Celebrity Judges") to determine fifteen (15) winners ("Winners") after May 1, 2020. The selection of the potential Grant (as defined below) recipients are final and binding in all matters related to the Grant Program. All entrants with Qualifying Applications will be considered for the Grant.

WINNERS NOTIFICATION: Non-winning entrants will not carry over into subsequent grant programs for consideration. The Winner will be notified by email, or phone, and will have 24 hours to claim their respective Grant. An authorized representative of the school with signing authority will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release ("Release") on behalf of the winning school and Winner, which must be received by Administrator, within two (2) days of the date notice or attempted notice is sent, in order to claim the Grant. If the Winner of any grant cannot be contacted, fails to sign and return the Declaration or provide any other requested information, within the required time period (if applicable), or the Grant is returned as undeliverable, the Winner forfeits the Grant. In the event that a Winner is disqualified for any reason, Administrator will award the applicable Grant to an alternate winner by judging from among all remaining Qualifying Applications. Additional alternate judging will be held until the Grant is awarded.

GRANTS: There will be approximately fifteen (15) Grant Program Winners, five (5) Winners from the High School category, five (5) Winners from the Middle School category and five (5) Winners from the Elementary School category. The Grant rewards are as follows (such grants are referred to individually as the "Grant"), provided that the Grant reward amounts may be adjusted in accordance with the Administrator's sole discretion:

High School: $10,000, $8,000, $6,500, $2,000, $1,000 Middle School: $7,500, $5,500 $4,000, $2,000, $1,000 Elementary School: $5,000, $3,500, $2,500, $1,000, $500

Grants are non-transferable and no substitution will be made except as provided herein at the Administrator's sole discretion. Winners are responsible for all taxes and fees associated with the Grant receipt and/or use. Odds of winning a Grant depend on the number of eligible entries received during the applicable Application Period. Limit: One Grant per Winner.

RELEASE: By applying to this Grant Program, entrants agree to release and hold harmless Administrator, Dallas Cowboys Football Club, Ltd. ("Dallas Cowboys"), any Dallas Cowboys player, Gene and Jerry Jones Family Foundation, the National Football League and its member clubs, Facebook, Twitter, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") mechanical errors and other errors, inaccurate, fraudulent, incomplete, late, lost, misdirected entries; or any delays in delivery of prize; or bodily injuries, death, losses or damages of any kind, without limitation, that may arise from or in connection with entrant's participation in this Grant Program or acceptance, possession or use of the Grant, or participation in grant-related activities.

PUBLICITY: Except where prohibited, participation in the Grant Program constitutes each entrants consent to Administrator and its agents' use of entrant's name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. In the case of Dallas Independent School District ("DISD"), in the event that Administrator wishes to use entrant's name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration, Administrator will contact entrant to obtain express prior written approval of the content from DISD. Approval or disapproval must be granted within forty-eight (48) hours of notification.

GENERAL CONDITIONS: This Grant Program is in no way sponsored, endorsed or administered by, or associated with Facebook or Twitter. Any questions, comments or concerns regarding the Grant Program must be directed to the Administrator, and not to Facebook or Twitter. Administrator reserves the right to cancel, suspend and/or modify the Grant Program, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Grant Program, as determined by Administrator in its sole discretion. Administrator reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Grant Program or to be acting in violation of the official rules of this or any other Grant Program or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Grant Program may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator's failure to enforce any term of these official rules shall not constitute a waiver of that provision.

LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Grant Program; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Grant Program; (4) technical or human error which may occur in the administration of the Grant Program or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Grant Program or receipt or use or misuse of any Grant. No more than the stated number of Grants will be awarded.

APPLICABLE LAW: This Grant Program and these official rules shall be construed and governed in accordance with the laws of the State of Texas. As a condition to participating in this Grant Program, each entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this Grant Program will be resolved individually, without resort to any form of class action, exclusively before a court located in the State of Texas. The entrant and Administrator hereby waive any and all right to trial by jury. If any provision of these official rules are declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law. All federal, state and local laws and regulations apply.
