TO ENTER: To be eligible, entrant ("Entrant") must provide the sponsor of this Fans United Photo Contest (the "Promotion"), Fans United, L.P. (the "Sponsors") with its full name, email address, phone number, zip code and date of birth. Limit one (1) entry per person. Sponsor will not be responsible for entries lost, delayed, incomplete or misdirected. Entries will become the sole property of Sponsor and by entering, Entrant expressly consents to adding his/her name to receive future promotional offers, and using Entrant's name for advertising, publicity or any other purposes whatsoever, as determined by Sponsor in its sole discretion, without compensation and with or without attribution to Entrant, as Sponsor elects.
METHODS OF ENTRY:
A. DallasCowboys.com Entry: Entrant may go to dallascowboys.com/summer-at-the-star, submit a photograph showing your favorite sports team gear ("Photograph") and follow the directions for registering.
B. Instagram Entry: To enter via Instagram, you must be a registered user on Instagram, must follow @OfficialFansUnited (www.instagram.com/OfficialFansUnited), and during the Promotion Period, post a photograph showing your favorite sports team gear tagging @OfficialFansUnited Instagram account and by using the hashtag '#SummerAtTheStar'.
C. Twitter Entry: To enter via Twitter, you must be a registered user on Twitter, must follow @ShopFansUnited (www.twitter.com/ShopFansUnited), and during the Promotion Period, post a photograph showing your favorite sports team gear tagging @ShopFansUnited Twitter account and by using the hashtag '#SummerAtTheStar'.
D. Facebook Entry: To enter via Facebook, you must be a registered user on Facebook, must like Fans United (www.facebook.com/OfficialFansUnited), and during the Promotion Period, submit a photograph showing your favorite sports team gear ("Photograph") and follow the directions for registering.
ELIGIBILITY: Promotion is open to legal residents of the United States. Must 18 years of age or older. Entrant is not eligible if he/she is an employee of Sponsor or a member of the immediate family (defined as parents, children, siblings or spouse, regardless of where they reside) or household of any of the above persons. By entering, Entrant agrees to abide by these rules and all decisions of Sponsor, which are final in all matters relating to this Promotion.
ENTRY PERIOD: The Promotion begins at or about 12:00 AM Central Standard Time ("CST") on July 8, 2019 and ends at 11:59:59 PM CST on July 19, 2019 ("Entry Period"). The Sponsor's computer is the Promotion's official clock.
PRIZES: There will be three (3) prizes:
• One (1) grand prize package (the "Grand Prize") consisting of one (1) trip to the Dallas Cowboys 2019 Training Camp in Frisco, Texas for two (2) guests during the week of August 18, 2019 and one (1) One Hundred U.S. Dollars ($100.00) shopping spree at Fans United. The trip will include hotel accommodations for two (2) guests for two (2) nights, three (3) meals for two (2) guests for two (2) days who are in attendance at training camp (excluding alcoholic beverages). Approximate retail value ("ARV") of Five Hundred And Fifty U.S. Dollars ($550.00).
• One (1) second place package ("Second Prize") consisting of two (2) tickets to one (1) 2019 Dallas Cowboys preseason home game (vs. the Houston Texans 8/24 or vs. the Tampa Bay Buccaneers 8/29) and one (1) One Hundred U.S. Dollars ($100.00) shopping spree at Fans United. ARV of Six Hundred U.S. Dollars ($600.00).
• One (1) third place package ("Third Prize") consisting of one (1) Fifty U.S. Dollars ($50.00) shopping spree at Fans United. ARV of Fifty U.S. Dollars ($50.00).
Sponsor reserve the right to substitute any portion of the Grand Prize, Second Prize and Third Prize (collectively the "Prizes") for one of equal or greater value. Winners may not request Prize substitution. Prizes are non-transferable and may not be claimed or used by any person other than the winner. By accepting the Prize, the winner agrees that Sponsor and its designees may use his/her name, voice, photograph, likeness, address (city and state), biographical information, Prize information and/or statements about this Promotion for advertising and publicity purposes in all media worldwide at the discretion of the Sponsor without limitation, further compensation or notice. Any portion of Prize not accepted by winner will be forfeited. Federal, state, and local taxes on Prize and all additional expenses incurred by the winner in accepting and exercising the prize not specified herein (including, without limitation, luggage fees, any additional travel [(e.g., travel to and from the airport)], food and/or accommodation expenses and any other expenses) are the responsibility of winner. ARV is as of the time the rules were printed and the value of a Prize may fluctuate. A winner is not entitled to any difference between the ARV and the actual value of the Prize at the time the Prize is awarded. Prizing, ticket location and value are subject to change. If a mutually agreed upon date cannot be found for 2019 season, prize fulfillment will not carryover to the 2020 season.
DRAWING/NOTIFICATION OF WINNER:
All eligible entries will be judged by Sponsor staff on or around July 22, 2019. After the Entry Period, three (3) potential winners will be selected among all eligible entries received to win a prize based on the following criteria:
* The sports team gear featured in the photograph - 50%
* Uniqueness of the imagery captured in the photograph - 50%
To be valid, entries must be received by Sponsor during the Entry Period. A Potential winner will be notified by telephone or email after the drawing with instructions on how to claim the Prize. The Prize winner will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (except where prohibited) and any other requested documents within the time period specified in the notification email or the Prize may be forfeited in its entirety and awarded to an alternate winner, at the Sponsor's sole and absolute discretion. Failure to provide all required information and a signature on the documents within the stated time period may result in forfeiture of winner's right to claim the Prize, and may result in the Prize being awarded to an alternate winner, if time permits.
DISCLAIMER:
Each Entrant in this Promotion agrees to release and hold harmless the Sponsor, Instagram, Dallas Cowboys Football Club, Ltd. ("Dallas Cowboys"), the National Football League and its member clubs, NFL Entities (as defined below), Cowboys Stadium, L.P., AT&T Services, Inc. (with respect to prize fulfilled at AT&T Stadium), Legends Hospitality, LLC, the City of Arlington, the City of Frisco, Frisco Silver Star Hotel Corporation, and each of their respective parent companies, divisions, related entities, affiliates and subsidiaries, and each of their directors, officers, employees, agents, representatives, successors and assigns, and all others associated with the development and execution of this Promotion, including without limitation, any prize providers (the "Released Parties"), from and against all claims, including but not limited to mechanical errors and other errors, inaccurate, fraudulent, incomplete, late, lost, misdirected entries; or any delays in delivery of prize; or bodily injuries, death, losses or damages of any kind, without limitation, that may arise from or in connection with Entrant's participation in this Promotion or acceptance, possession or use of the prize(s), or participation in prize-related activities.
By participating in this Promotion, Entrant acknowledges and agrees: (i) to be bound by these official rules, all Sponsor-related terms and conditions, as well as the decisions of Sponsor which are final and binding in all respects; (ii) to waive any rights to claim ambiguity with the official rules; (iii) it owns all copyright in and to the Photograph submitted; (ii) it has obtained authorization from any and all individual(s) featured in the Photograph submission and confirmed those individual(s) have agreed to allow Entrant to submit the Photograph bearing their name, image and/or likeness in connection with the Promotion; (iv) it assigns any and all rights in copyright and any other rights to the Photograph to the Sponsor, any and all of its subsidiaries, affiliates, and it's agents; (v) that this assignment is valid and is non-revocable; (vi) the Sponsor's rights in and to the Photograph shall include, but not be limited to, the sole right now and forever to use, copy, publish, display, perform, edit, modify, alter, adopt, record or re-record, distort, make derivative works from, make composites containing, or seek any available legal protection in such Photograph and resulting works or materials, or any portion thereof, in any manner and for any purpose (including without limitation advertising, editorial, trade, merchandising, or promotional activities) whatsoever, alone or in connection with any other materials, in any forms or media known now or hereafter, and without any inspection or pre- or post-approval by Entrant and without compensation, nor any other property or equitable rights in or to the Photograph and resulting works and materials, or in any work which a Photograph might be used shall be owed to Entrant; and (vii) it will indemnify, defend and hold the Released Parties harmless from any and all damages, liabilities, fees and costs incurred in defending against any claim or threat of a claim asserted against any of the Released Parties related to the intellectual property rights in and to the Photograph granted by Entrant to Sponsor.
APPLICABLE LAW: This Promotion and these official rules shall be construed and governed in accordance with the laws of the State of Texas. As a condition to participating in this Promotion, each Entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this Promotion will be resolved individually, without resort to any form of class action, exclusively before a court located in the State of Texas. The Entrant and Sponsor hereby waive any and all right to trial by jury. If any provision of these official rules are declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law. All federal, state and local laws and regulations apply.
GENERAL: This promotion is in no way sponsored, endorsed or administered by, or associated with, Twitter, Facebook or Instagram. If, for any reason the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right at its sole discretion to cancel, suspend or modify this Promotion, in whole or in part without notice.
